If you are interested in purchasing a house or a building plot in Poland and you are not a citizen of any of the EU or EEA countries, you will unfortunately need to obtain permission from the Minister of the Interior and Administration.

Please note that not all properties require a permit; foreigners can purchase property in Poland without a permit from the Ministry of the Interior and Administration, as follow:
- Independent housing units
- Garages or shares in property intended for garages
- A property if the foreigner has been living in Poland for at least five years since obtaining a permanent residence permit or a residence permit for a long-term EU resident.
- A property that will become part of a joint property (if the spouse is a Polish citizen and they have been living together in Poland for at least two years since obtaining a permanent residence permit or a residence permit for a long-term EU resident).
- A property owned by an individual who has been its owner or perpetual usufructuary for a minimum of five years, as well as by a foreigner who is entitled to inherit from such an individual at the time of acquisition.
A foreigner who is an entrepreneur must additionally demonstrate that the property he/she intends to purchase is necessary for conducting his/her business activity.
Obtaining a permit is a complicated process that takes a considerable amount of time and requires the acquisition of various documents: These include:
- Passport or residence card (if applicable)
- Extract from the relevant register or records (if the foreigner is running a business in Poland)
- Duplicate of the land and mortgage register or certificate from a collection of documents
- Abstract from the land register with an extract from the cadastral map
- Please provide an abstract from the applicable spatial development plan, or a decision on determining the location of a public purpose investment, or a decision on development conditions.
- You will also need to provide a current statement of the seller on the intention to sell the property, including detailed information about the property.
Please note that all documents must be valid for six months from the date of their issue. In addition, foreign documents should be notarised with an apostille or legalised in Poland.
Moreover, be aware that the proceedings before the Ministry of the Interior and Administration can take up to two months, though this can be longer.
